Legal Ways to Obtain Cannabis in Germany

Der 1. April 2024 hat die Regeln für Cannabis in Deutschland neu geschrieben. Ob als Medizin oder zum Genuss: Es gibt jetzt mehrere legale Wege, an die Pflanze zu kommen. Dieser Guide zeigt, wie es geht – und was die jeweiligen Haken und Ösen sind.

1. Medizinisches Cannabis auf Rezept

Wie funktioniert es?

Der Weg zum medizinischen Cannabis führt klassisch über den Arzt. Seit dem neuen Medizinalcannabisgesetz (MedCanG) von 2024 reicht dafür ein normales Rezept, ein Betäubungsmittelrezept (BtM) ist nicht mehr nötig. Dieses Rezept können Sie in jeder Apotheke einlösen – vor Ort oder bei einer Versandapotheke.

Voraussetzungen

• Es muss eine ärztliche Diagnose für eine Erkrankung vorliegen, bei der eine Cannabistherapie eine anerkannte Behandlungsoption darstellt.
• Ein ärztliches Rezept ist zwingend, das seit der Gesetzesänderung aber kein spezielles BtM-Rezept mehr sein muss.
• Typische Indikationen sind chronische Schmerzen, ADHS, Schlafstörungen, Spastiken bei MS oder Übelkeit während einer Chemotherapie.

Kosten

Als Selbstzahler auf Privatrezept muss man mit Kosten zwischen 5 und 15 Euro pro Gramm rechnen, abhängig von Sorte und Apotheke. Eine Kostenübernahme durch die Krankenkasse ist zwar möglich, doch der Antragsprozess gilt als mühsam. Nur rund 60 Prozent der Anträge werden genehmigt. 2. Telemedizin-Plattformen

Ein Rezept für Medizinalcannabis, ohne das Haus zu verlassen – das ermöglichen Telemedizin-Plattformen. Nach einer Videosprechstunde wird das Rezept direkt an eine Versandapotheke übermittelt, die die Medikamente per Post liefert.

Was dafür spricht

• Die Behandlung lässt sich vollständig von zu Hause aus durchführen.
• Termine bei den spezialisierten Ärzten sind oft innerhalb weniger Tage verfügbar.
• Die beratenden Ärzte haben in der Regel umfassende Erfahrung mit der Cannabis-Therapie.
• Die Lieferung der Medikamente erfolgt diskret per Post.

3. Cannabis Social Clubs

Für den legalen Genusskonsum gibt es neben dem Eigenanbau eine zweite Option: die Mitgliedschaft in einem Cannabis Social Club. Seit dem 1. Juli 2024 dürfen diese sogenannten Anbauvereinigungen offiziell starten, um ihre Mitglieder zu versorgen.

So funktioniert die Mitgliedschaft

• Voraussetzung ist die Volljährigkeit und ein Wohnsitz oder gewöhnlicher Aufenthalt in Deutschland.
• Du trittst einem behördlich genehmigten Club bei, der auf maximal 500 Mitglieder beschränkt ist.
• Die Abgabe ist limitiert: höchstens 25 Gramm pro Tag und 50 Gramm pro Monat.
• Der Club erhebt einen monatlichen Mitgliedsbeitrag plus einen Abgabepreis pro Gramm.
• Eine Mitgliedschaft in mehreren Clubs gleichzeitig ist gesetzlich ausgeschlossen.

4. Eigenanbau

Die wohl direkteste Form des legalen Zugangs: Jeder Erwachsene darf in Deutschland bis zu drei Cannabispflanzen für den Eigenbedarf zu Hause anbauen.

Regeln beim Eigenanbau

• Maximal drei weibliche, blühende Pflanzen sind pro volljähriger Person im Haushalt erlaubt.
• Der Anbau ist ausschließlich am eigenen Wohnsitz oder gewöhnlichen Aufenthaltsort gestattet.
• Pflanzen und Ernte müssen sicher vor dem Zugriff durch Minderjährige und Dritte geschützt werden.
• Saatgut darf aus EU-Ländern importiert oder über Social Clubs bezogen werden.
• Achtung: Die zu Hause gelagerte Ernte darf die erlaubte Besitzmenge von 50 Gramm nicht überschreiten.

Das aktuelle Gesetz ist nur der erste Schritt. Als „Säule 2“ plant die Bundesregierung Modellprojekte mit kommerziellen Lieferketten und lizenzierten Fachgeschäften. Der Zeitplan dafür ist jedoch völlig offen und hängt von der Abstimmung mit der EU ab. April 1, 2024, rewrote the rules for cannabis in Germany. Whether for medicinal or recreational use, there are now several legal ways to obtain the plant. This guide shows how it works – and what the respective pros and cons are.

1. Medical Cannabis on Prescription

How does it work?

The classic way to medical cannabis is through a doctor. Since the new Medicinal Cannabis Act (MedCanG) of 2024, a normal prescription is sufficient; a narcotics prescription (BtM) is no longer required. You can redeem this prescription at any pharmacy – on-site or at an online pharmacy.

Requirements

• There must be a medical diagnosis for a condition for which cannabis therapy is a recognized treatment option.
• A medical prescription is mandatory, but since the law change, it no longer has to be a special narcotics prescription.
• Typical indications include chronic pain, ADHD, sleep disorders, spasticity in MS, or nausea during chemotherapy.

Costs

As a self-payer with a private prescription, you can expect costs between 5 and 15 euros per gram, depending on the strain and pharmacy. While reimbursement by health insurance is possible, the application process is considered cumbersome. Only about 60 percent of applications are approved. 2. Telemedicine Platforms

Telemedicine platforms make it possible to get a prescription for medicinal cannabis without leaving your home. After a video consultation, the prescription is sent directly to an online pharmacy, which delivers the medication by mail.

• Treatment can be carried out entirely from home.
• Appointments with specialized doctors are often available within a few days.
• Consulting doctors typically have extensive experience with cannabis therapy.
• Medication delivery is discreetly handled by mail.

3. Cannabis Social Clubs

For legal recreational consumption, there is a second option besides home cultivation: membership in a Cannabis Social Club. Since July 1, 2024, these so-called cultivation associations are officially allowed to start supplying their members.

How membership works

• Prerequisites are legal age and a residence or habitual abode in Germany.
• You join an officially approved club, which is limited to a maximum of 500 members.
• Distribution is limited: a maximum of 25 grams per day and 50 grams per month.
• The club charges a monthly membership fee plus a dispensing price per gram.
• Membership in multiple clubs simultaneously is legally excluded.

4. Home Cultivation

Probably the most direct form of legal access: Any adult in Germany is allowed to cultivate up to three cannabis plants for personal use at home.

Rules for home cultivation

• A maximum of three female, flowering plants are allowed per adult in the household.
• Cultivation is only permitted at one's own residence or habitual abode.
• Plants and harvest must be securely protected from access by minors and third parties.
• Seeds may be imported from EU countries or obtained through Social Clubs.
• Caution: The harvest stored at home must not exceed the permitted possession quantity of 50 grams.

Looking Forward: Will Specialized Stores Arrive?

The current law is only the first step. As "Pillar 2," the German government plans pilot projects with commercial supply chains and licensed specialized stores. However, the timeline for this is completely open and depends on coordination with the EU. The Europe-wide cannabis debate and projects like in Switzerland, where sales in pharmacies are already being tested, could influence the process.

Partial legalization has fundamentally expanded the options for patients and consumers.
